Which route applies to you

This page is titled "DMCA report" because that is the term most rights holders and agencies search for, and we would rather be findable than pedantic. It is worth knowing, though, that the DMCA is United States legislation and Canada has no equivalent notice-and-takedown statute. Copyright complaints in Canada run through the notice-and-notice regime at sections 41.25 to 41.27 of the Copyright Act.

The practical difference: under the US regime a service receiving a valid notice must act expeditiously to remove or disable access to the material. Under the Canadian regime a service receiving a compliant notice must forward it and retain records — it is not statutorily required to remove anything, though it may do so voluntarily.

Rights holders may approach us under either framework, so the requirements for both are set out below. Send us whichever applies to you; we will act on either.

Filing a report

Under Canadian law — notice-and-notice (ss. 41.25–41.27)

To be compliant, a notice must be in writing and must state:

1. The claimant's name and address, and any other contact information we would need to reach them.
2. Identification of the work or other subject-matter in which copyright is claimed.
3. The claimant's interest or right in that work.
4. The electronic location data identifying the material in question.
5. The infringement being claimed.
6. The date and time of the alleged infringement.

A notice that contains an offer to settle, a demand for payment, or a request for personal information does not comply with the regime and we will not forward it.

Under the US DMCA (17 U.S.C. § 512(c)(3))

Rights holders proceeding under US law should include:

1. A physical or electronic signature of the copyright owner or an authorised agent.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material claimed to be infringing, with enough detail to locate it.
4. Contact details for the complaining party.
5. A statement of good-faith belief that the use is not authorised by the owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information is accurate and that the complaining party is authorised to act.

Where to send it

We acknowledge compliant notices within [ NUMBER ] business days. Please send notices to the address above rather than through WhatsApp or general support, so they are logged correctly and not lost in a support queue.

What we do when we receive one

1. We acknowledge receipt and record the notice, the date it arrived, and what it concerns.
2. Where the notice is compliant and concerns a party we can identify, we forward it as required.
3. We review the material identified and take the action described in the section below.
4. We retain records of the notice for the period required under section 41.26(2).

Our position on the material we carry

Counter-notice

If you are a subscriber or partner and material of yours has been removed or disabled in error, write to the same address with your contact details, identification of the material and its location before removal, and an explanation of why you believe the removal was mistaken. We will review it and reply.

Repeat infringement

Accounts subject to repeated substantiated copyright complaints may be suspended or terminated without refund, at our discretion. This applies to resellers as well as direct subscribers.

Misuse of this process

Knowingly making a material misrepresentation in a copyright notice carries consequences under both Canadian and US law, including liability for damages and costs. We keep records of notices received.
